The cargo security regulations proposed  by the Bureau of Customs and Border Protection has been finalized.  Details were published in the July 23rd edition of the Federal Register.  Under the new rules all modes of transportation (air, ocean, truck and rail) of goods into or out of the Customs territory of the United States must be electronically filed before the arrival of the goods.  The cargo data required to be reported in these new rules include cargo description, origin and final destination of goods and complete names and addresses of shippers and consignees.  The rules are expected to go into effect on October  21, 2003.  Below you will find the modes of transport and their corresponding time periods for filing of cargo data prior to import or export:
 
Air Import - If the merchandise "originates in the Americas north of the Equator," then the cargo data is reported at the time of departure, or once the wheels are up.  Cargo from all other destinations require data to be filed via the Automated Manifest System (AMS) 4 hours prior to arrival into the United States.
Air Export - 2 hours prior to departure with the data submitted electronically via the Automated Export System (AES).
 
Ocean Import - 24 hours prior to departure via AMS.
Ocean Export - 24 hours prior to departure via AES.  For merchandise requiring an export license, the data must be filed via AES 72 hours prior to departure.
 
Truck Import - 30-60 minutes prior to arrival.  Truck arrivals will use one of the following 4 systems for cargo data submission:  the Free and Secure Trade (FAST) system, the Pre-arrival Processing System (PAPS), the Border Release Advanced Screening and Selectivity system (BRASS), or the Customs Automated Forms Entry System (CAFES).
Truck Export - 1 hour prior to arrival at the exporting border.
 
Rail Import - 2 hours prior to arrival via AMS.
Rail Export - 4 hours before a locomotive is connected to a train departing for Canada or Mexico via AES.
